Security, Landlord May Be Held Liable in Shooting;Victim May Be Beneficiary of Security Contract

In the Bronx a claim was brought by a man who was shot in a multi-family apartment building. The victim was visiting a friend in the building finding the locks broken and a security guard never asked him to sign in. There was a group of 10 or 12 men in the lobby despit no loitering signs. Upon leaving the building an altercation began and the victim was shot while the security guard did nothing until after the shots were fired. The building owner and the security company tried to get out of the case but the Court said the security company was there not only to protect property but to protect lives and thus it owed a duty to the victim. The owner of the building may be held responsible as the assailant was an intruder who entered the building through broken locks.
