We always think about who the defendant is when we star a lawsuit. It does make a difference. You have to know who your opponent will be. This article will focus primarily on the New York City Transit Authority. Over the years we have had many cases against the City of New York as well as the New York City Transit Authority. If you were hurt on a New York City train and there is negligence then you have the luck of having the Transit Authority as your opponent. Why do I say that with a sarcastic tone? Imagine you are a boxer and you come to the match and you see your opponent already in the ring talking and laughing with the referee. Imagine that whenever you fight this one opponent he gets to have the same referee all the time.You,on the other hand, get different referees for all your different opponents except for this particular one who always gets the same referee. The same referee that he is yacking to before the fight and before you get there. Starting to get the picture? The New York City Transit Authority gets to go before only one or two judges(so does the City of New York) while the rest of us have to go many different judges. I dont really understand the reasoning behind it, though I hear it has something to do with financial constrains and judicial economy. Sorry I don't buy it and if you ask me I think its unconstitutional. What does this have to do with your case taking so long? I'm not sure but know this. In a typical accident case both sides must exchange what is called discovery and be prepared to produce wittnesses for depositions. This is usually the most consuming time of a case. What if one side decided that they would not give me any of that discovery and made me request a court order for every document and wittness that I needed.What if that side said "screw you we are not giving you anything"? What if that side said the same thing after one court order? Two court orders? Three? Can you see what happens to the case? Before you twist and turn you have argued for two three years before anything happens. Why? A great deal of judges just dont want to penalize the Transit Authority for whatever reason.Remember these judges see the same lawyers for the Transit Authority all the time.Is there a connection?

Recently, we represented a New York City Police Officer for injuries against the Transit Authority. The lawyers for the Transit have delayed discovery for two years because, in my honest opinion,
they just want this to go on forever and without any resolution.The decision here shows how some judges slap the Transit Authority.
