Should you feel guilty or bad about bringing a personal injury lawsuit? Yes if it's made up or if the injury is so small that all you are doing is clogging up the system. If you are asked to buy into one of these myths read on:

Myth:The number of lawsuits has increased dramatically.

Answer: Not true. Under President George W. Bush, the Justice Department found that personal injury cases resolved in United States Districts Courts fell by 79 percent from 1985-2003. It was also found that personal injury cases tried in court were only about 800 in 2003, where in 2003, where in 1985 the number was well over 3,600. From statistics in a recent study done by the Administration's Bureau of Justices Statistics it was also shown that personal injury trials at a state level has has been reduced significantly.

Myth: Health Care Costs are increasing and doctors are unable to practice due to litigation:

Answer: Health care costs are increasing but litigation and medical malpractice has nothing to do with it. According to the Congressional Budget Office , medical malpractice cases accounts for less than 2% of all health care spending. Medical malpractice cases have not affected American's access to health care. There has been a 40% increase in the number of physicians since 1990 , when the U.S. population has only increased by 18%.

Myth: Legal reform is needed because it hurts small businesses.

Answer: False. Surveys have shown that small business owners are not concerned with lawsuits. Manufacturers suggest that "lawsuit abuse" is one of the least concerns for them.In a survey done in 2008 by the National Federation of Independent Businesses, "cost and frequency of lawsuits" ranks 65 on a list of worries.

Myth: Trial attorneys are charging outrageous fees and leave victims with nothing if they win

Answer: Personal Injury attorneys do not charge by the hour but rather on a "contingency fee basis". This allows for people who would not otherwise be able to pay legal fees to have their day in court.

Myth: My insurance rates are dramatically increasing because of lawsuits.

Answer: The increase of insurance rates has nothing to do with lawsuits. It is all about the insurance industry's profit. In 2007, insurance companies have reported that they made a profit of $61.9 billion, where in 2004 they reported a profit of $38.7 billion.
