            <title><![CDATA[Sexual Assault and the Military—A Long Island Personal Injury Lawyer’s Perspective]]></title>

Why is no one talking about the victims and their rights? This past week, Leah Marquet, 20, and Anne Kendzior, 22, both filed suit in Manhattan federal court, claiming that the Naval Academy in Annapolis, Maryland and the Military Academy in <a title="West Point Military Academy" href="http://www.usma.edu/">West Point</a>, New York both tolerate sexual assault by discouraging alleged victims from reporting incidents. According to the suit, West Point and the <a title="United States Naval Academy" href="http://www.usna.edu/homepage.php">Naval Academy </a>&ldquo;systematically and repeatedly ignore rampant sexual harassment. Both institutions have a history of failing to prosecute and punish those students found to have sexually assaulted and raped their fellow students.&rdquo;</span></span><br /><span style="font-family: Calibri; font-size: medium;">&nbsp;</span><br /><span style="font-size: medium;"><span style="font-family: Calibri;">Like so many military students, Marquet and Kendzior arrived at the military academy as top honor students and star athletes who had a wide choice of colleges but chose West Point and the Naval Academy respectively. Both tell of <a title="sexual assault lawyer" href="http://www.eglaw.com/practice_areas/new-york-and-long-island-sexual-assaults.cfm">sexual assaults </a>that occurred in their first year that left them depressed, suicidal and afraid to come forward. Both did report the incidents and request investigations, but have never heard anything more. The Pentagon now estimates that approximately 19,000 sexual assaults occur each year in the military. In fact, women in the military are more likely to be raped by American soldiers than to be killed in combat.</span></span><br /><span style="font-family: Calibri; font-size: medium;">&nbsp;</span><br /><span style="font-size: medium;"><span style="font-family: Calibri;">In a recent CNN interview, Leon Panetta, the Secretary of Defense, spoke up about the need to follow through on sexual assault claims and see that assailants are brought to justice. Panetta announced he has created a Special Victims Unit to investigate sexual assault allegations, and that sexual assault allegations will be dealt with at the level of colonel instead of slowly making their way up through the chain of command.</span></span><br /><span style="font-size: medium;"><span style="font-family: Calibri;">&nbsp;</span></span><br /><strong><span style="font-size: medium;"><span style="font-family: Calibri;">But will real change come? </span></span></strong><br /><span style="font-size: medium;"><span style="font-family: Calibri;">Unfortunately, it is too late for Karley Marquet, Annie Kendzior and so many other victims.             <title><![CDATA[How Much is a Broken Nose Worth when You’re Suing Apple?]]></title>
            <description><![CDATA[<br /> <span style="font-size: medium;"><span style="font-family: Calibri;">When Evelyn Paswell, of Forest Hills, walked into glass doors, she didn&rsquo;t walk into just any building&rsquo;s doors. This was the Apple Store in Manhasset, owned by a company worth an estimated $100 billion dollars. That&rsquo;s right&mdash;$100 billion, more than the total GNP of two thirds of the world&rsquo;s nation. So now she is suing <a title="apple" href="http://www.apple.com/">Apple</a> for $1 million&mdash; $75,000 for medical expenses and the remainder for negligence. Is a broken nose really worth anywhere near $1 million? Does she even have a case at all?&nbsp;<br />&nbsp;</span></span><br /> <span style="font-size: medium;"><span style="font-family: Calibri;"><span style="text-decoration: underline;">The quick facts</span>: Last December, Paswell was going to the Apple store in <a title="manhasset apple store" href="http://www.eglaw.com/library/manhasset-new-york-personal-injury-lawyer.cfm">Manhasset</a> to return an iPhone. Apparently, she didn&rsquo;t notice the glass building and crashed into it, breaking her nose.<br /> </span></span><br /> <span style="font-size: medium;"><span style="font-family: Calibri;">Paswall claims that the signature glass walls that house Apple&rsquo;s famous stores are a menace to the elderly and believes that she should be compensated for her injury. And just how fast was Paswell walking that she actually broke her nose when she hit the glass? As of Saturday, there were white strips located on the base of the doors&mdash;it is unclear whether they were there before the accident, but they do add another visual clue for customers. Lots of people occasionally walk into doors, poles, trees, lampposts. Doesn&rsquo;t mean they have a lawsuit.             <title><![CDATA[Crossing Long Island Streets with Headphones? Think Twice]]></title>
            <description><![CDATA[<span style="font-size: medium;"><span style="font-family: Calibri;">While New York laws have helped raise awareness of the dangers of texting and driving, little attention has been paid to pedestrians using earphones and electronic devices when navigating the sidewalks and streets of Long Island and New York City. A newly published study confirms what many would suspect, that pedestrians distracted by earphones are more likely to be in an accident.</span></span><br /><span style="font-size: medium;"><span style="font-family: Calibri;">In a study published this week in the journal <a title="injury prevention" href="http://injuryprevention.bmj.com/"><em>Injury Prevention</em></a>, researchers found that the number of pedestrians wearing headphones that were killed or injured by moving vehicles has tripled since 2004. The problem with headphones is that not only is the user distracted by what they are listening to, but they are also unable to hear sounds around them, such as a car speeding towards them or a horn blasting a warning. </span></span><br /><span style="font-size: medium;"><span style="font-family: Calibri;">Dr. Richard Lichenstein, the study&rsquo;s lead author and the director of pediatric emergency medicine research at the <a title="university of maryland medical center" href="http://www.umm.edu/">University of Maryland Medical Center</a>, said he decided to study the topic after reading headline after headline about pedestrians being killed while wearing headphones. &ldquo;Unfortunately, as we make more and more enticing devices, the risk of injury from distraction and blocking out other sounds increases,&rdquo; he said.</span></span><br /><span style="font-size: medium;"><span style="font-family: Calibri;">The study found two-thirds of the victims were male and younger than 30. More than half the victims were struck by a train.. About 55 percent of the vehicles involved in the headphone-related accidents were trains, and 29 percent of the vehicles involved used a horn or other type of audible warning system to let the pedestrians know they were there. This bill would add college employees to a list of mandated child-sex abuse reporters that already includes K-12 teachers, physicians, and coaches. If a college employee is convicted of failing to report child sex abuse, he or she could face a misdemeanor charge and a year in jail.
