A:
In most railroad accidents the railroad will claims that the employee either caused the accident or substabtially contributed to his injuries. Many cases that we have seen in this office involve actions by employees that can be characterized as contributing to their negligence. However, that does not mean the railroad is not at fault. In fact the law is wriiten in such a way that even actions by employees that one would normally consider as a tough case against the railroad does not prevent a claim from being made. See our recent blog on this subject and review some of our articles on FELA cases in New York.
