I was injured in a car accident and the other driver was drunk. What are my rights?

When you are injured in a car accident and the other driver was drunk there are several important things that determine your rights.

Whose fault was the accident? If the accident was your fault, you do not get money just because the other driver was drunk.

If the other driver was responsible for the accident, you have a very good case against them. However, that person may not have ample insurance or resources to pay for your injuries. Sometimes, there are other parties you can also sue that may have some responsibility. For example, if the other driver became intoxicated at a bar, nightclub, restaurant or somebody’s home there maybe additional liability from that individual or party. Were they continually served drinks even after being noticeably intoxicated and then allowed to drive away? Are they under 21 and were served alcohol and a home or business?

Also keep in mind that a civil lawyer can only claim money damages from any lawsuit. We can’t take away anybody’s license or put anybody in jail. That is done in criminal court.
