The simple answer is you cant sue your employer. There are few employees that have that right. However you  can  sue other companies and parties that are on the work project. For example if your company was hired by the general contractor to install siding on a new building and you have been injured you may be able to bring a lawsuit against the GC and the owner of the property. The law in New York is very favorable for construction workers and the owner of the property and the GC remain responsible for many of the activities and tasks on the job. Always speak to an attorney that understand this area of the law.
