I was hurt at a construction site. Can I sue my employer?

If you were injured at a construction site, you may have a case against another party, but you can not sue your employer. With few exceptions, employers can’t be sued. You can receive worker’s compensation to cover the medical bills and lost wages for a work-related accident on a construction site.

However, you still may have a case. Very often, other companies or parties are either fully or partly responsible for an accident that occurs on a  work site. This might include general contractors, equipment companies and building owners. For example, if your company was hired by the general contractor to install siding on a new building and you have been injured, you may be able to bring a lawsuit against the general contractor and the owner of the property.

The laws in New York favor construction workers, and the property owners and general contractors remain responsible for many of the activities and tasks on the job.
