I slipped and fell at Roosevelt Field mall on Long Island. Can I sue the mall?

Whenever you slip and fall, the important factor in determining if you have a case is whether or not there was a defect on the property that the owner knew about, or should have known about, that caused your fall.  So if a cracked floor tile, a leak that caused puddles, or a broken step were left unfixed for days, these are conditions that could be witnessed and should be fixed immediately by the owner because they are known to cause accidents. But if you trip over a bag someone just dropped or if it's raining outside and you trip over water from people's shoes, you probably do not have a case.
