A Nassau County jury returned a verdict against Allstate Insurance Company and in favor of the plaintiff in this motor vehicle accident. The plaintiff was a pasenger in a vehicle which was going straight when the offending vehicle made a left turn in front of the vehicle she was in. The plaintiff a 58 year old self employed mother suffered a wrist fracture and resulting surgery. In addition she has been diagnosed with Reflex Sympathetic Dystrophy. The insurance company for the vehicle that made the left turn tendered their limited policy and Allstate refused to look and evaluate their file until trial. At trial they offered a five figure settlement which they withdrew after a "take or leave it" position. While we encourage setllements we agreed with the client who decided not to take the money. The client would have accepted a very high five figur number or a low six figure number. After 3 hours of deliberation the jury came back with a favorable verdict and the case was resolved for a number that was almost twice what the plaintiff would have accepted.
