Our client was a construction worker in his thirties when he fell from an open stairway that was being built for an estate on the North Shore of Long Island. The client was on the second floor when he accidentally fell through an opening where there should have been a secured barrier or railing to prevent falls. The owner of the home astonishingly did not have insurance. The general contractor did not have insurance. The client's employer did not have insurance. The court granted summary judgement on behalf of the plaintiff.The client was paralyzed from below his waist. He will need medical care for the rest of his life and he will need special provisions made for his home.The case was prepared for trial and a jury was selected. Prior to opening statements the case was resolved for a high seven figure number. Most of the settlement was paid for by a State agency (this occured because of the client's grave injury) and a significant amount was paid by the uninsured homeowner and general contractor.
