Will New York and Long Island Restaurants Be Able To Sue BP For Oil Spill

ATTENTION! - RESTAURANTS OWNERS IN NEW YORK AND LONG ISLAND
  It appears that the BP oil spill is much larger than first expected. In fact estimates are now that there may be up to 25,000 gallons of oil being leaked into the Gulf. The original estimate was 5,000 gallons a day. As of today the most recent effort to contain the spill is having , at best, modest results. This has already been declared as the worst oil disaster in United States history. The Oil Pollution Act of 1990 created after the Exxon Valdez spill creates liability for damages from oil spills but caps damages at 75 million dollars This could be a problem since the current disaster is sure to surpass this amount very quickly. There are ways to get pierce this cap depending on BPs negligence. There also is a fund created by the Government that could assist in damages. Experts warn that The Loop Current, which pushes into the Gulf of Mexico from the Caribbean and then moves clockwise toward Florida, could potentially carry oil into the powerful Gulf Stream. Should that happen, the effects of the spill will spread to the Florida Keys, Florida's Atlantic beaches, and even futher north along the Atlantic coast.
If you own a  restaurant or business in seafood industry in New York or Long Island it may be too early to know if your business will sustain any damages. However its not too early to sit down and talk to a lawyer about what your rights may be.
