
A parent's worst nightmare is to bury their child. The thought of having a child pass before his or her parents is terrible. Now imagine for one moment if that parent visits the grave of their child and finds something strangely wrong. In fact that's what happened to Nicole Pailliere when she was visiting her son's grave at Greenfield Cemetary in Uniondale Long Island. When visiting her son's grave she noticed fresh flowers and disrupred soil. It appears that the cemetary mistakenly buried somebody on top of her son. The Town of Hempstead said that an official at Greenfield Cemetery in Uniondale has been suspended and reforms will be put into place because of a string of mistakes at the cemetary. Now I hear about a Freeport woman who is filing a Notice of Claim against The Town of Hempstead because her husband was reburied without notification to the family. Now my first thought was this is terrible but why bring a legal claim. What are the damages for a lawsuit? How much can you really get and how much will a lawyer make litigating this type of case. However after a little more thought I said to myself "This is very bad and what kind of message would we be sending if a legal claim wasn't started? I am not talking about the car accident where the victim goes to the doctor one time and has a scratch on his finger. I guess the question all accident and personal injury lawyers must ask themselves is the following: Are there some cases even though there are minimal damages( small fees for the lawyer) that should be handled for the sake of justice and fairness. I think there are and I think that most lawyers that I know here on Long Island and New York have taken on these type of claims. Your child or spouse being reburied is one of those claims.
