Railroad Employee Accidents-The One Thing You Need To Know

I have been litigating railroad FELA claims for over twenty years and the most shocking thing that I find from all the calls I get is this:

Many railroad employees don't think they have a case because they believe the accident was their own fault and the railroad is not responsible!

All I can say when I hear that is bullsh*t! There are a few times when there may be no responsibility of the railroad but the majority( and I mean like 95%) of the calls I take involve some railroad responsibility. In fact after hearing the details of the accidents from the prospective client I have to remind them:

You are working one of the most dangerous jobs in the United States!

In fact  the original statute which congress passed and gave railroad employees the legal right to sue their employer(most employees cant sue their employer for workers compensation reasons)was done so because the railroad industry was considered inherently dangerous. The law which was enacted also made it much easier to find the railroad responsible for employee accidents. This was done so that the railroad would adhere to strict safety standards. We have had very successful recoveries for railroad employees who were burned from electrical explosions as well as back injuries from lifting accidents. All of these clients thought they did not have a case because of what they believed was their own fault in the accident. What any railroad employee needs to know is:

Most railroad employee accidents are due in part to the fault of the railroad.Don't assume you don't have a legal case until you speak to a railroad accident lawyer!
