Long Island first-time DWI defense lawyer

Comments (1)

I was just charged with my first DWI…What should I do?

Getting pulled over for a DWI is terrifying for a reason—you’re facing stiff fines, losing your license, a criminal record and possibly jail time. If convicted, it could jeopardize your job, education choices and relationships. But all is not hopeless—and choosing the right Long Island DWI lawyer could mean avoiding jail time, reducing your charges or even getting them dismissed altogether.

How can a lawyer help me?

Right from the beginning, the lawyer is working for you and doing everything he or she can to get you the best possible outcome. This means investigating the circumstances of why you were pulled over and examining every stage of the arrest to look for contradictions or mistakes that can work in your defense. For example:

  • The policeman that pulled you over needed to have probably cause. You can’t be stopped arbitrarily for suspicion of drunk driving.
  • Even if you were legitimately pulled over for suspicion, an officer must have probable cause to arrest you. Bad driving is not a valid reason for a DWI arrest.
  • The officer probably administered field sobriety tests. These tests are not always accurate and the results can be influenced by mediation, medical issues, vision problems, roadside distractions, nerves, fatigue and fear.
  • There is a set protocol that needs to be followed when you are arrested. For example, were you read your Miranda Rights?

In addition, your lawyer will investigate the scene where you were pulled over and thoroughly examine the road conditions, weather and other factors that may have caused you to drive poorly when you were pulled over.

If you drunk and driving your vehicle and that time if any one took breath test, then you have entered into case. That time they used to seal your licence, then good attorney will create some stories about you and maximum he will try to take out.
